Terms of Service

These Terms of Service ("Terms") are a binding legal agreement between you ("you" or "User") and Nexgale Dynamics Private Limited, a company incorporated under the laws of India with its registered office in Vadodara, Gujarat, India ("Company", "we", "us", or "our"), governing your access to and use of the website scanvify.com and all associated services (collectively, the "Service" or "Scanvify").

By creating an account, submitting a URL to be scanned, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy and Refund Policy, which are incorporated into these Terms by reference. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under the Indian Contract Act, 1872 to use the Service. By using the Service, you represent that you meet these requirements.

2. Your account

• You may create an account using Google Sign-In or an email address and password. We do not offer sign-in via email links.
• You must provide your name, a valid email address, and (where applicable) a password of at least 8 characters, and keep this information accurate and up to date.
• You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at the contact address below if you suspect unauthorized use of your account.
• You are not required to create an account to run a free scan. Anonymous use is supported, subject to the same acceptable-use rules below.
• We may suspend or terminate accounts that provide false information, are used fraudulently, or otherwise violate these Terms.

3. What the Service does

Scanvify is an automated tool that examines the publicly accessible behavior and configuration of a website URL you submit, and produces a report identifying issues and suggested repair instructions. The Service performs passive, non-intrusive checks only (e.g. reading public pages and headers) — it does not attempt to exploit, breach, brute-force, or gain unauthorized access to any system.

The Service is a launch-readiness and general-health check. It is not, and must not be relied upon as: a penetration test; a security, accessibility, or legal-compliance certification of any kind; a guarantee of search engine ranking, performance, uptime, or business outcomes; or professional legal, security, tax, or accessibility advice. Automated scanning has inherent limits — a finding may be a false positive, and the absence of a finding does not mean your site has no problems.

4. Acceptable use

You agree that you will:

• Only submit URLs that you own, operate, or are otherwise authorized to have scanned. You are solely responsible for confirming you have this authorization before submitting a URL.
• Not use the Service to attack, overload, probe for vulnerabilities beyond what the Service itself performs, or gain unauthorized access to any website, system, or network.
• Not attempt to circumvent any usage limit, rate limit, or free-scan restriction we apply (including by using multiple accounts, devices, or IP addresses for that purpose).
• Not reverse-engineer, scrape, resell, or use automated means to access the Service outside of its intended use through the website.
• Before applying any repair suggestion to your own website, back up or version your site, apply changes one at a time, preview each change, and verify your key flows (e.g. checkout, forms, login) before publishing.
• Remain solely responsible for any change you make to your website, including changes made using our suggested prompts or instructions — the Service only produces suggestions; you (or your website builder/developer) implement them.

We may investigate and take appropriate action — including rate-limiting, suspending, or terminating access, without refund — against anyone who violates this section.

5. Plans, pricing, and payment

• Free scans are limited (currently to the homepage of a site, and to a daily number of free scans per site to prevent abuse). We may change these limits at any time.
• Paid plans unlock a full, multi-page report for a one-time fee shown before purchase — in Indian Rupees (₹, inclusive of applicable Goods and Services Tax unless stated otherwise at checkout) for purchases made in India, or in US Dollars (USD) for purchases made from outside India.
• Purchases in India (₹) are processed by Razorpay, a third-party payment gateway. We do not receive or store your card, UPI, or bank account details — Razorpay handles this directly. Your use of Razorpay is also subject to Razorpay's own terms.
• Purchases outside India (USD) are made from and processed by Polar Software Inc. ("Polar"), which acts as the merchant of record: Polar is the seller of the purchase for payment, tax, and receipt purposes, collects your payment details, applies any taxes required in your jurisdiction, and emails your receipt. Those purchases are also subject to Polar's own terms. The report and the Service itself are provided by us under these Terms in both cases.
• If you are not signed in when you purchase, we will ask for your email address so we can send you a copy of your invoice or purchase confirmation and keep a record of your purchase. If you are signed in, your billing history is available at any time from your account's billing page.
• For purchases made in India, we issue a GST tax invoice, generated on demand from your purchase record (see Section 6). For purchases made via Polar, your payment receipt is issued by Polar as merchant of record — we do not issue a separate GST invoice for those purchases.
• Prices may change at any time for future purchases; a change does not affect a purchase you have already made.

5a. Monthly subscriptions

In addition to one-time reports, we offer monthly subscription plans (currently for customers in India, billed in ₹ via Razorpay) that grant a recurring monthly allowance of full-depth scans.

• Recurring billing. A subscription is a recurring payment mandate (UPI Autopay, e-mandate, or card, depending on what you authorize with Razorpay) that automatically charges the plan's price at the start of each ~30-day billing period, for up to 12 billing cycles, unless you cancel sooner. Your scan allowance resets to the plan's full amount at the start of each new period; it does not accumulate.
• Unused scans do not carry over. Scans left unused at the end of a billing period are forfeited when the next period starts (or when the subscription ends) — they are not refunded, credited, or added to the following period's allowance.
• Cancel anytime. You can cancel from your account's billing page at any time, with no minimum term. Cancelling stops future renewals — it does not end your current billing period early: you keep your remaining scan allowance and full access until the end of the period you already paid for, after which the subscription ends and no further charge is made.
• No partial refunds for cancellation. Because you retain full access and your remaining scans for the rest of the period you already paid for, cancelling does not entitle you to a refund for any unused portion of that period. See our Refund Policy for the limited circumstances in which a refund may still be considered.
• Extra scans. If you use your full monthly allowance, you may purchase additional one-off scans ("top-ups") at the price shown at the time of purchase; top-ups are a one-time charge, not a recurring one.

6. Billing and GST invoices

Nexgale Dynamics Private Limited is registered for GST in India. Every paid purchase is issued a sequentially numbered tax invoice showing the taxable value, applicable GST rate, and GST amount, generated from our records at the time you view or download it — we do not pre-generate or permanently store invoice files. Company and tax registration details shown on your invoice (including our GSTIN) are maintained by us and kept current. If you require a corrected invoice (for example, a company name or GSTIN for your own input-tax-credit purposes) that we were not able to capture at checkout, contact us at the address in Section 18.

7. Refunds

We do not offer a general refund policy — see our Refund Policy for the complete terms, including the limited circumstances in which a refund may be considered. Your purchase of the Service constitutes acceptance of that policy.

8. Intellectual property

The Service, including its software, design, text, and the Scanvify name and logo, is owned by the Company and protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the reports and repair instructions generated for your own website(s) for your own personal or business purposes. You may not resell, sublicense, or redistribute the Service itself, or represent scan reports as an independent third-party certification or audit of another party's website without our prior written consent.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, error-free, or fully accurate, or that every issue on your website will be detected. Some features of the Service (for example, live Google Lighthouse testing, AI-assisted expert review, live vulnerability feeds, and malware/blocklist checks) depend on third-party services we do not control and which may be temporarily unavailable, rate-limited, or discontinued.

10. Limitation of liability

To the maximum extent permitted by law, neither the Company nor its directors, employees, or agents will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or relating to your use of the Service, changes you make to your website (whether or not based on our findings), or any security incident affecting your website. Our total aggregate liability to you for any claim arising out of or relating to the Service will not exceed the amount you actually paid us for the specific scan giving rise to the claim in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Indian law.

11. Indemnification

You agree to indemnify and hold the Company harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from: your breach of these Terms; your submission of a URL you were not authorized to have scanned; or your misuse of any finding, report, or repair instruction provided by the Service.

12. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, misused the Service, or created risk or legal exposure for us. You may stop using the Service, or request deletion of your account, at any time by contacting us. Sections of these Terms that by their nature should survive termination (including Sections 8 through 11 and 17) will survive.

13. Privacy

Our collection and use of personal information in connection with the Service is described in our Privacy Policy.

14. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the Service, applicable law, or our business practices. If we make a material change, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

15. Force majeure

We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, internet or hosting infrastructure failures beyond our reasonable control, government action, or failures of third-party services (including our payment processor, cloud hosting, or DNS providers) that we depend on.

16. Severability & entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and the Company regarding the Service and supersede any prior agreements on the same subject.

17. Governing law & jurisdiction

These Terms are governed by the laws of India, without regard to its conflict-of-law principles. Subject to applicable consumer protection law, you agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts at Vadodara, Gujarat, India.
